Zages has been the president of the Warburg Pembina Surface Rights Group for 30 years, supporting fellow landowners as they navigate their relationships with the oil and gas companies that drill on their land. "Why did I get involved? Because of the injustice there is with the oil and gas industry," Zages said. Farmers, ranchers and other landowners only own the surface rights to their land. When an oil or gas company purchases the mineral rights, the landowner has no choice but to allow the company to drill through their land. In exchange, landowners are paid an annual fee that is part rental payment and part compensation for the lost productivity on that parcel of land. The lease signing for this shotgun marriage often happens quickly and quietly between a well-prepared company landman and a minimally-informed landowner who is ill-equipped to parse the legal documents and under-educated on the risks they will face. "Anything the oil company wanted, they got," said Zages. "There's an injustice in enforcing regulations. If this was not true, there would not be all these inactive wells."
