In my opinion, there should always be consent when someones image is being used commercially. The law right now is that in a public place, no model has an expectation of privacy and thus her image may be taken, and sold, without her permission. But what if your T-shirt explicitly says No Model Release. No Image Rights? would that be legally binding if captured in the same image? Right now the status quo does not feel right and I think further discussion needs to be had.
